Agreement to Terms

By accessing or using Bolverk's behavioral intelligence platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Description of Service

Bolverk provides AI-powered analysis of qualitative research data, applying psychological frameworks to identify behavioral patterns and generate actionable insights. Services include:

  • Automated multi-framework analysis
  • Adversarial validation of insights
  • Confidence-scored recommendations
  • Interactive report dashboards
  • API access (Enterprise tier)

Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate registration information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access

You are responsible for all activities under your account.

Acceptable Use

You agree to use the Service only for lawful purposes. Prohibited activities include:

  • Violating laws, regulations, or third-party rights
  • Uploading malicious code, viruses, or harmful content
  • Attempting to breach security or gain unauthorized access
  • Reverse engineering or copying the platform
  • Using the Service to analyze data you do not have rights to use
  • Reselling or redistributing our analysis services without authorization
  • Generating content that violates intellectual property rights

Data Ownership and Usage Rights

Your Data

You retain all ownership rights to the research data you upload ("Input Data"). You grant us a limited license to process Input Data solely to provide the Service.

Generated Insights

Analysis reports, insights, and recommendations generated by our platform ("Output") are owned by you. We do not claim ownership of Output.

Platform Improvements

We may use anonymized, aggregated usage statistics to improve our platform. We do not use your specific Input Data or Output to train models or for purposes unrelated to your analysis.

Service Tiers and Billing

Subscription Plans

Bolverk offers multiple tiers (Starter, Professional, Enterprise) with varying features, analysis volume, and turnaround times.

Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • Payment is due immediately upon subscription
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

Service Level and Availability

We strive for high availability but do not guarantee uninterrupted access. We are not liable for:

  • Scheduled maintenance periods
  • Third-party service outages
  • Force majeure events
  • Issues caused by your network or equipment

Analysis turnaround times are estimates, not guarantees.

Intellectual Property

The Bolverk platform, including software, algorithms, design, and documentation, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without written permission.

Confidentiality

We treat your Input Data as confidential. For Enterprise customers, we offer NDAs upon request. See our Privacy Policy for data handling details.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • Analysis results will be error-free or complete
  • Defects will be corrected
  • The Service will be secure or virus-free

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLVERK SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding amounts paid to us in the 12 months prior to the claim

Indemnification

You agree to indemnify and hold Bolverk harmless from claims arising from:

  • Your violation of these Terms
  • Your Input Data or use of Output
  • Your infringement of third-party rights

Termination

We may suspend or terminate your account:

  • For violation of these Terms
  • For fraudulent or illegal activity
  • Upon your request
  • If required by law

Upon termination, your access ends immediately. Data deletion follows our retention policy.

Dispute Resolution

Any disputes shall be resolved through:

  • Good faith negotiation
  • Binding arbitration (if negotiation fails)

Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email 30 days before taking effect. Continued use after changes constitutes acceptance.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bolverk regarding the Service.
